JUDGEMENT

(1.) When learned counsel for the State referred the fact that this is second visit of applicant under Sec. 438 of Cr.P.c. before this Court and no new ground is being raised and other accused are still absconding and further referred the role of applicant in case diary, then counsel for the applicant sought withdrawal of this application with liberty to submit before the course of justice and seek regular bail.
