JUDGEMENT

(1.) PROJECT Director, National Highway Authority of India (NHAI), incharge of National Highway between Jabalpur and Katni is also present. It is stated by him that the repairing work of the road has already commenced. A contractor has been assigned the work, who would complete the entire work before 31 st July 2012. It was also informed by him that the work done by him is under guarantee for the period of one year and during this period, the contractor shall maintain the road and see that it will remain motor able. It is also informed by him that the process for construction of four- lane road is also in the process ,However, 750 acres of land is further required for construction of the aforesaid lane. Out of this, it was submitted by him that for acquisition of 650 acres of land, the matter has been sent to the NHAI, Delhi. There are near about 80% of the land which are further required for the construction of 4 lane road. it was also submitted that the road between Jabalpur and Katni has been made motorable. So far as the road between Katni and Maihar is concerned, the work is in progress and near about 20 Km of road which was in a very bad condition, restrengthening work is going on, out of which 7 Kms road has already been re-constructed and has been made motorable. So far as remaining work, which is in progress is expected to be completed by 31st July 2012. It was also assured by Shri Jain that though 31st July is the Last date of completion of work, but he is expecting that work would be complete much prior to this date.

(2.) THAT by the end of this month, the entire repairing work between Jabalpur and Katni is expected to be completed. The aforesaid statement is taken on record. Shri Jain submitted that he shall follow the work for acquisition of the land but it requires active cooperation of the concerned SDOs within whose jurisdiction the land is to be acquired. It was submitted that if the cooperation of the concerned SDOs is extended then the acquisition work can be completed at an early date. To this it was submitted by Shri Naman Nagrath that cooperation of the concerned SDOs shall be extended.However, it was submitted by Shri Naman Nagrath that till date initial notification for acquisition of the land has not been published so at present there is no role of the SDOs and in fact,the NHAI has to publish the notification. On drawing attention to this fact, Shri Jain submitted that all the relevant datas for acquisition of the land have been sent in the month of March 2012 and he himself is personally pursuing the matter and expecting that the notification shall be published very soon. The aforesaid statement is also taken on record. So far as national highway between Jabalpur-Mandla -Chilpi is concerned, Shri Verma, Executive Engineer present in Court is directed to file a specific affidavit in respect of present status of the aforesaid road within a week before this Court. It was submitted by him that out of 189 Kms, 72 Kms road is still with NHAI and on remaining road work is going on. Out of this, 15 Kms and 27 Kms road in two parts which are under performance guarantee,these are also maintained. So far is remaining 46 Kms road is concerned, he shall file a specific affidavit in this regard. The prayer is allowed. Jabalpur-Lakhnadon -Nagpur National Highway:
