THIS is first application under section 438 Cr.P.C. filed by the applicants for their anticipatory bail in Crime Case No.200/2011 registered against them on the complaint of a private person that the applicants have entered into an agreement with him for selling a government land about four years ago prior to registration of the case against them.

It is submitted by the learned counsel for the applicants that the dispute between the parties is of civil nature as according to him the land that was agreed to be sold by the applicants to the complainant came under the Ceiling Act after the date of agreement of sale. According to him, there is no element of cheating on the part of the applicants. This Court would not like to express any opinion on the merit of the contentions urged on behalf of the applicants as it is likely to cause a prejudice to either of the parties at the trial of the case. However, having regard to the nature of the accusations and other facts and circumstances of the case, the applicants are ordered to be released on bail in the event of their arrest by the arresting officer on their furnishing bail bond in the sum of Rs.50,000/ - (Rs. Fifty Thousand) each with one solvent surety each in the like amount to the satisfaction of the arresting officer. The applicants are directed that they shall abide by the conditions enumerated under section 437 (3) Cr.P.C. and shall participate in the investigation as and when called by the investigating officer.
