JUDGEMENT

(1.) Heard through Video Conferencing. This is the first application filed by the applicant under Section 439 Cr.P.C. for grant of bail during the trial.

(2.) The applicant is facing trial for offence punishable under Section 3/7 of Essential Commodity Act registered at Police Station-Kakanwani, District-Jhabua in Crime No.294/2020. He is in jail since 07.12.2020.

(3.) The allegation against the applicant is that he along with the other co-accused Dharmesh was involved in selling diesel unauthorizedly without any licence, which was kept in an underground tank of the capacity of 12,000 liters.
