JUDGEMENT

(1.) Heard learned counsel for the parties through video conferencing.

(2.) This is first application filed under section 439 Cr.P.C. seeking bail in connection with Crime No.852/2020 registered at police station Chimanganjmandi, district Ujjain for the offence punishable under sections 323, 324, 294, 506 and 307/34 of the IPC.

As per prosecution story in the night of 27.06.2020 near about 8 P.M there was a dispute between the complainant Jitendra Dube and his brother Danesh Dube (injured) with Suraj, Kamal, Shyam and Chhotu. The reception of marriage of the present applicant was going on and the applicant and the injured were passing through the road. They were assaulted by the accused and the present applicant took out the knife and inflicted injury below his stomach. Initially, FIR was registered under sections 323, 324, 294, 506 and 34 of the IPC and after receipt of the query report from the medical officer offence under section 307 IPC has also been added and the present applicant was arrested.
