JUDGEMENT

(1.) This is the first bail application filed by the applicant under Sec. 439 of the Cr.P.C.

(2.) The applicant is in custody since 2/12/21 in connection with Crime No.968/2021 registered at P.S. Excise Circle, District Khandwa (MP) for the offence punishable under Sec. 34(2) of the M.P. Excise Act.

(3.) As per the prosecution case, it is alleged that on the basis of secret information, police recovered 54 bulk liters of hand made liquor from the possession of the applicant.
