(1.) CHALLENGING the action of respondent No.2 Avdhesh Pratap Singh Vishwavidyalaya, Rewa in cancelling the Post Graduate Degree granted to the petitioner in the year 1997, petitioner has filed this writ petition.
(2.) PETITIONER after completing his Graduation i.e... BA, from Bundelkhand University, Jhansi in the year 1982-83, took admission as a regular student in a Post Graduate Course i.e... MA in (Geography), and obtained his Post Graduation Degree in the year 1987 from Bundelkhand University, Jhansi. Annexure P/2 is the mark-sheet issued to the petitioner in this regard. After having obtained the Post Graduation Degree from Bundelkhand University, Jhansi in the year 1987, petitioner again applied and took admission in MA Previous (Geography) as a Post Graduate student in Avdhesh Pratap Singh Vishwavidyalaya, Rewa. He pursued his studies and obtained Post Graduation again in MA (Geography) from the said University in the year 1994-95, as is evident from the mark-sheets and degrees granted to him vide Annexures P/3, P/4 and P/5. It is the case of the petitioner that on the basis of the Post Graduate Degree in Geography obtained by him from Avdesh Pratap Singh Vishwavidyalaya, Rewa he was selected as a Scientist in the establishment of the Remote Sensing Applications Centre respondent No.4, and is working in the said establishment when all of a sudden after a period of six years by the impugned notification and orders Annexures P/11 and P/13, the Post Graduation conferred on him is cancelled.

HAVING heard learned counsel for the parties and on a perusal of the records, it is clear that there is no dispute with regard to the factual aspects of the matter, it is an admitted position that petitioner had obtained Graduation from Bundelkhand University, Jhansi in the year 1983 and he had also completed his Post Graduate study i.e... MA in (Geography) from Bundelkhand University, Jhansi, in the year 1987. When he took admission again in MA in (Geography) previous year with Avdesh Pratap Singh Vishwavidyalaya, Rewa in the year 1994, petitioner did not disclose to the University the fact about his being a Graduate and Post Graduate from Bundelkhand University, Jhansi. Instead, the records indicate that he took admission by indicating that he has passed the Acharya Examination conducted by the Sampoornanand Vishwavidyalaya, Benares in the year 1986, and produced a transfer certificate and other documents in support thereof. It is not known as to why the petitioner indulged in this act of misrepresentation in the matter of getting admission to MA Previous in Geography in Avdesh Pratap Singh University. Respondents are right in contending that the petitioner got admission by misrepresentation and playing fraud on the respondent University.
