(1.) BEING aggrieved of the orders dated 10.7.2000 passed by the Joint Registrar, Cooperative Societies, Raipur in Appeal Case No. 78-18/2000 the appellant has preferred this second appeal under the following circumstances :
(2.) APPELLANT was appointed as a Clerk in respondent No. 3 bank on daily wages by order dated 17.12.1995 and he joined there on 1.1.1996. He was continuously working upto 1.7.1999. By order dated 1.7.1999 the services of the appellant have been terminated without assigning any reasons and without conducting any enquiry against him. He filed a dispute Case No. 12/99 before the Dy Registrar, Cooperative Societies, Raipur challenging the legality of his termination order. Dy Registrar by his order dated 17.2.2000 dismissed the dispute case, against which the appellant's appeal has also been dismissed by the learned Joint Registrar by his impugned order. Now the appellant has filed this second appeal on the ground that his termination order is illegal and contrary to law. He was not afforded any opportunity of hearing before issuance of this order. By order dated 1.7.1999 the service of five employees were terminated including the appellant, but later on two of them have again been appointed by the respondent No. 3 bank. Dy Registrar has also committed judicial impropriety by reinstating Surendra Singh and Smt. Sapna Agrawal and directing to regularise their services and appoint in regular posts. Their petitions were also based on the same ground as that of the appellant. But the Joint Registrar has illegally dismissed the dispute case of the appellant.
(3.) I have heard the learned counsel appearing for the parties and also perused the record of the Courts below. The only point that arises for consideration is whether the orders of Courts below and also the termination order of the appellant are contrary to law and liable to be set aside.
