JUDGEMENT

(1.) AS directed under s. 66(2) of the Indian IT Act, 1922, the Tribunal, Bombay, has referred to this Court for its opinion the following question of law :

(2.) WE may mention here that the validity of this provision was challenged, and affirmed by the Supreme Court in Jain Brothers vs. Union of India (1970) 77 ITR 107 (SC).
