AJAY MEHTA Vs. STATE OF MADHYA PRADESH

JUDGEMENT

(1.) Heard through video conferencing.

(2.) This is the first application under Section 439 of Cr.P.C., for grant of bail filed on behalf of the applicant - Ajay Mehta. The applicant Ajay Mehta , co-accused Guddu Mehta and one Sukha - Juvenile are accused in connection with crime No. 710/2019 registered at Police Station Barwani District Barwani for the offence punishable under sections 302 read with Section 34 of IPC. Applicant is in custody since 09.11.2019. Co-accused Sukha who is juvenile has been released on bail by the Juvenile Court.

(3.) As per prosecution story, in the night of 13.10.2019, deceased Raju fell while riding motorcycle near Gram Bandhan Square. Information was received on 19.10.2019 and FIR was registered on 08.11.2019. In fact, after having suffered injuries, Raju was hospitalized in Vadodra, Gujarat where he died on 15.10.2019. Merg was registered and accordingly information was received at the concerned police station. Accordingly, case has been registered against the applicant.
