(1.) It is alleged by the counsel for the applicant that the applicant has been falsely implicated in the case and he has not committed any offence in any manner. As per the prosecution story, the applicant was arrested for the offence under Section 13 of the Public Gambling Act. At that time, the applicant misrepresented about his name and address. Subsequently, when attempt was made to arrest to ensure his presence before the Court below in proceedings initiated, it was found that impersonation was done by the applicant. The applicant has shown his name to be Rakesh Mishra and put signature in the name of Rakesh Mishra. At subsequent point of time, it was found that the applicant was Sunil Mishra who impersonated as Rakesh Mishra. The applicant is in custody since 11.02.2020. There is no possibility of absconding or tampering with the prosecution. Counsel for the applicant prays for grant of bail to the applicant.
(2.) Per contra, learned Public Prosecutor for the State has opposed the application stating that the applicant has been acquitted in five criminal cases. The investigation is pending in the matter and the charge sheet has not been filed. Allegation against the present applicant is of making sign as Rakesh Mishra. As far as the other offences are concerned, order sheets have been filed by the applicant.
(3.) Considering the overall facts and circumstances of the case, this Court deems it appropriate to allow this bail application. Accordingly, the application is allowed subject to verification of the fact that no other offences are pending against the applicant and it is directed that the applicant be released on bail on furnishing a personal bond in the sum of Rs.50,000/- (Rs. Fifty Thousand Only) with one solvent surety each in the like amount to the satisfaction of the concerned trial Court.
