DURGA BAI Vs. STATE OF M.P.

JUDGEMENT

(1.) This is the first application under Section 439 of Cr.P.C. for grant of bail on behalf of the applicant as she is in custody since 17.02.2020 in connection with Crime No.81/2020 registered at Police Station Sihora, District Jabalpur for the offences punishable under Sections 294 , 323 , 324 , 307 , 506 , 302 / 34 of the IPC.

(2.) The allegation against the applicant is that she along with other seven persons who are her family members were involved in assault and murder of one Raj @ Chintu Dumur.

(3.) Learned counsel for the applicant has submitted that the applicant is a lady aged around 35 years and is the mother of two minor daughters aged 4 and 8 years respectively. He further submits that the incident took place at the spur of the moment at the house of the mother of the applicant on a trivial issue with the neighbour in which aforesaid Raj @ Chintu Dumur died.
