JUDGEMENT

(2.) This is first bail application filed on behalf of the applicant under Section 439 of the Code of Criminal Procedure. The applicant is in custody since 01.02.2020 in connection with Crime No. 306/2019 registered at Police Chowki-Khamarpani P.S. Bichua, District- Chhindwara (M.P.) for the offence punishable under Section 363 , 376(2) (n) of IPC & Section 4/6 of POCSO Act.

(3.) On 06.12.2019, applicant-accused kidnapped the prosecutrix aged 17 years 8 months, thereafter prosecutrix recovered on 26.01.2020 from the possession of present applicant-accused. It is alleged that present applicant- accused committed intercourse with her.
