JUDGEMENT

(1.) As per prosecution story, complainant purchased plot bearing survey No.604, 660, 664/1, 664/3 at village Khajrana, District Indore vide registered sale deed dated 06/03/1997. Thereafter in the year 2015 he came to know that some un-social elements have encroached certain land in that particular survey number and electricity connections have also been taken illegally. Later on, it was found that applicant alongwith his friend have encroached his plot.

(2.) Learned counsel for the applicant has submitted that the applicant is innocent and he has been falsely implicated in the present crime. No forged document has been recovered from his possession and there is no cogent documentary evidence available on record to show that the applicant has encroached the plot of the complainants and running his business by constructing shop in the said location. It is further submitted that applicant has ever claimed the ownership of the plot in question. He has no objection if the possession of the said plot is handed over to the complainant party. The applicant is in custody since 25/08/2019. Investigation is over and charge-sheet has been filed. Conclusion of trial will take considerable time. Under these circumstances, learned counsel prays for grant of bail to the applicant.

(3.) Learned Panel Lawyer submits that no sufficient ground is made out for releasing the applicant on bail, hence the application filed by the applicant be dismissed.
