JUDGEMENT

(1.) Learned counsel for the rival parties are heard. Present appeal filed u/S. 14(A)(2) of the Act assails the order dated 28/2/2020 passed by the Special Judge (Atrocities), District Guna (M.P.) whereby the application preferred by the appellant herein u/S. 439 of Cr.P.C . came to be rejected.

(2.) The appellant is in custody since 03.01.2020 in connection with Crime No.3/2020, registered by Police Station Vijaypur, District Guna (M.P.) in relation to the offences punishable u/Ss. 363/366/376 IPC and Sec.

(3.) (1)(W)(2)/3(2)(VA)/3(2)(V) of the SC and ST Act . 3. Learned Public Prosecutor for the State, on the other hand, prayed for dismissal of the appeal by contending that on the basis of the allegations and the material available on record, no case for grant of bail is made out.
