JUDGEMENT

(1.) Heard through video conferencing.

(2.) This is the first application under Section 439 of Cr.P.C., for grant of bail filed on behalf of the applicant. The applicant is in custody since 19.06.2020 in connection with crime No. 310/2020 registered at Police Station Rajgarh District Rajgarh for the offence punishable under sections 363 IPC.

(3.) As per prosecution story, the applicant is the brother(Rakhi Bhai) of complainant Laad Bai -mother of the prosecutrix. It is alleged that applicant had taken the prosecutrix Payal to a temple with her mother's permission. Payal by using applicant's mobile phone had called her friend Sunil and there from had gone away with him. Sunil had used her for sexual abuse against her wishes.Accordingly, the case has been registered against the applicant.
