SANGEETA PAL Vs. STATE OF M.P.

JUDGEMENT

(1.) This is a First application under Section 438 of Cr.P.C. by the applicant - Sangeeta Pal W/o Yogesh Pal, who apprehend her arrest by Police in connection with Crime No.289/2020 registered at Police Station Sanyogitaganj, District Indore, concerning offence under Sections 306 and 34 of the IPC.

(2.) Heard the learned counsel for the parties through video conferencing and perused the case diary.

(3.) As per prosecution story, Yogesh Pal and the deceased Manish Pal are real brother and they are sharing the common house. On 02.11.2019, there was an altercation between both the brothers which resulted in the registration of FIR at Crime (NCR) No.235/2019 under Section 323 and 504 of IPC. That on the next date i.e. 03.11.2019 Manish Pal committed suicide by hanging himself. The wife of deceased Manish Pal lodged an FIR against the Yogesh, applicant (wife of Yogesh) and their son making allegation that they used to harass her husband since last so many years, and that has instigated him to commit suicide.
