AMAR SINGH Vs. STATE OF M.P.

JUDGEMENT

(1.) This is First application under Section 439 Cr.P.C. by applicant - Amar Singh S/o Kesar Singh Chouhan, who has been arrested by Police on 25.08.2019 in Crime No.769/2019, Police Station Vijay Nagar, District Indore concerning offence under Sections 447 , 448 , 506 , 384 , 386 , 420 , 467 , 468 , 471 and 34 of the IPC.

(2.) Heard the learned counsel for the parties through video conferencing and perused the case diary.

(3.) As per prosecution story, Monika Jain being a registered owner of plot No.C-11, Gruh Awas Yojna situated at survey No.660 made a complaint in the Police Station that Mukhtyar, Amar Singh and Farukh have illegally encroached over the aforesaid plot.During investigation the Police has recorded the statement of aforesaid three accused in which they disclosed the name of other accused. As per the allegation, co-accused Ranjeet Singh had entered with an agreement to sale with Sarita Batham for sell of plot No.22, Radhika Kunj Colony survey No.664/1 and 604.
