JUDGEMENT

(1.) In pursuance of the directions issued by the Apex Court and guidelines issued by the High Court of Madhya Pradesh in the wake of COVID-19 outbreak, the matter was taken up through video conferencing while adhering to the norms of social distancing prescribed by the Government.

(3.) Learned counsel for the rival parties are heard. This first criminal appeal has been preferred under section 14-A(2) of the Act against the impugned order dated 06.08.2020 passed by Special Judge (under the Act), Datia, whereby appellant's application under Section 439 of the Code of Criminal Procedure has been rejected by the Court below.
