JUDGEMENT

(1.) PLAINTIFF having lost the legal battle from two Courts below has tried to seek entry in High Court in Second Appeal under section 100 of CP Code questioning the legality and correctness of the impugned judgment and decree rendered by Additional District Judge, Shujalpur, in Civil First Appeal No. 65-A/95. dated 13.2.1997, arising out of C.S. No. 206-A/83, dated 2.8.1989, passed by learned 1st CJ, Class II, Shujalpur.

(2.) PLAINTIFF by filing the suit claimed declaration of his title to the suit land. In the first place he claimed to be in possession by oral lease in his favour, i.e. possessory title. He also relied on plea of adverse possession contending that qua defendants, he has acquired title to the suit land by virtue of adverse possession. He also alleged that he being in possession continuously since 1969, has acquired the rights of occupancy tenant.
