(1.) This appeal is preferred against the judgment dated 27-1-1997 in Sessions Case No. 384 of 1996 on the file of the Sessions Judge, Chittoor against the conviction under Section 302, IPC and sentence of imprisonment for life imposed against the appellant-accused.
(2.) The allegations in the charge-sheet in brjel are that P.W.1 - Talari Srinivasulu, and the accused are the residents of Kalikapuram Hanjanawada. The deceased (1) Ravuri Ayyappa, aged 6 years and (2) Ravuri Kannaiah, aged 4 years are the sons of the accused. The accused owing to some disputes with his wife, being disgusted with her, decided to die with his sons. He purchased some pesticide granules from the shop of P.W.3 al Nagari and administered the same with two bananas to his two children, resulting in their instantaneous death which occurred on 20-5-1996 at 6.00 p.m.
(3.) The incident of giving bananas by the accused to his children was witnessed by P.W.1 and another person by name Kuppaiah. They tried to catch hold of the accused, but the accused pushing P.W.1 aside escaped from there. P.W.6 - Sub Inspector of Police, Vijayapuram, on receipt of complaint from P.W.1 registered the same as a case in Crime No. 41/96 under Section 302, IPC. P.W.7 - Inspector ot Police held inquest on the dead bodies ol the two deceased in the presence of P.W.5 and another, and sent the dead bodies for post-mortem examination to Government Hospital, Puttur. The Post Mortem report reveals that the deceased died of Asphyxia because of consumption of Insecticide poison. The Forensic Science Laboratory report discloses that corbonate group of insecticide poison caused the death of the children.
