JUDGEMENT

(1.) Heard the learned Counsel for the appellant as well as the Public Prosecutor.

(2.) The allegations levelled against the appellant are that, he committed a murder on 16-7-1992 in the evening hours in the outskirts of Chelpur village. The deceased Sadala Rajeshwari who was the wife of the accused was aged 18 years and was native of Bobbalonipalli. The deceased was married to the accused-appellant four years back. They led happy life for about a year, but later the accused began suspecting her character and began quarrelling with her stating that she had illicit and extra marital relations with some others. At the instance of the appellant panchayats were held with intention to divorce the deceased. The deceased was daughter of the maternal uncle of the accused therefore most of the relations were common to both and they were interested in ensuring that the appellant lives happy life with the deceased, but the deceased did not change her attitude and had quarrels with the appellant. Since the attempts of the accused to get divorce failed and since the decease did not change her attitude the accused planned to kill her and thereby got rid of his wife.

(3.) It was alleged that on 16-7-1992, in the evening hours the accused asked the deceased to accompany him to go to the house of PW1. The deceased accompanied the accused. They were walking towards Bobbulonipalli h/o Chelpur. While so, the accused took her to the nearby well where nobody was present and took the opportunity of being alone with his wife and attacked the deceased, beat her with a stick on her head, chest and other parts of the body causing fatal internal injuries due to which the deceased died on the spot. After making himself sure that she was dead, he threw the dead body into the well and returned home.
