JUDGEMENT

(1.) The Writ Appeal under clause 15 of the Letters Patent is filed assailing the order passed by the learned single Judge of this Court in Writ Petition No. 3362 of 1998 dated 31-07-1998.

(2.) Appellant herein is the petitioner in the said Writ Petition No. 3362 of1998 which was filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the respondents in issuing notification inviting tenders only from the Public Sector Undertakings for supply of antibiotics is violative of Articles 14 and 19 (1) (g) of the Constitution of India and a further direction to the respondents to allow the petitioner- company and other companies to participate in the tenders for the supply of antibiotics to the respondents.

(3.) For the sake of convenience, the parties are referred to as per their arrayin the Writ Petition No. 3362 of 1998.
