JUDGEMENT

(1.) This batch of writ petitions are filed by the students who are included in the merit list prepared on the basis of the EAMCET-1989 examination conducted by the respondent-University for admission to academic year 1989-90 in M.B B.S. and B.D.S. etc. courses challenging the validity of the action of the respondents in denying consideration to the petitioners for admission to M.B.B.S. Course in the resultant vacancies and also the validity of changes made this year in Rule 11 by the University.

(2.) The University has opposed the writ petitions mainly on the ground that change made is to avoid delay in admissions. The relevant portion of para 2 of the counter-affidavit of Registrar-in-charge sworn to on 25-9-1989 reads as follows:

In the reply-affidavit the petitioners have also questioned the authority of the University to frame the Rules of admission and also their validity on the ground of inconsistency with the provisions of the Andhra Pradesh Educational Institutions (Regulation of Admissions and Prohibition of Capitation Fee) Act, 1983 (hereinafter referred to as Act 5 of 1983) and the Rules framed by the State Government under it for admission to Courses in Medicine. They have also pointed out the arbitrary manner in which the admissions are made to a professional course. 3 Sri B. Adinarayana Rao, learned counsel appearing in one of the Writ petitions has made principal submissions and other counsel have supplemented them. The learned Advocate-General hat appeared for the respondent-University.
