JUDGEMENT

(1.) Common questions arise in these writ-appeals and writ-petitions. The writ-appeals are preferred against the Judgment of the learned single Judge allowing the writ petitions. Since the writ-appeals preferred against the said Judgment were pending the other writ-petitions were directed to be heard along with the writ-appeals. For the sake of convenience, we shall refer to the parties with reference to their description in the writ-petitions.

(2.) The writ-petitioners are all medical graduates. They passed their MBBS Examination from different Medical Colleges in the State. According to the Rules, they are entitled to MBBS Degree only after they complete one year’s internship after qualifying at the MBBS final year examination. This internship has to be completed in hospitals attached to colleges from which they pass their MBBS Examination. For example, if a student has passed MBBS Examination from Guntur Medical College, he must do his internship in the hospital attached to that college. Stipend of Rs. 800.00per month is provided to them during the period of internship.

(3.) Certain students had been requesting the Government to permit them to do their internship in hospitals other than those attached to their colleges. This request was made on the ground of convenience. Initially there was no provision for transferring internees from one hospital, to another hospital, or, for that matter, for permitting an internee to do his internship in a hospital other than the one attached to his college. Such a facility was provided for the first time in G O.Ms.No. 1076, dated 9-11-1976. Transfer was allowed in, and subject to certain conditions. G.O.Ms. No. 1076 was later replaced by G.O. Ms. 1012, Medical & Health, dated 7-10-1977. It reads:-
