(1.) The petitioner seeks a direction in the nature of mandamus to admit her into the 1st year M.B.B.S Course for the year 1987-88 in the Kakatiya Medicial College in the Osmania University area.
(2.) The brief formate of the case is. The petitioner appeared, for theentrance test conducted by the .respondent authorities for admission into the 1st year MBBS Course for the academic year 1,987-88. As per the averments made .in the affidavit filed in support of the petition, the petitioner belongs to B,C, ('A' Group). The number of seats reserved for local candidates in the Osmania University area is '276'. In the test conducted she has secured rank No. 3105. Out of the '6' seats allotted to the women candidates as per the reservation, '3' were given to 'local candidates', who have secured ranks higher than the petitioner. Out of them one Kum. Sujanamma with rank No. 2133 did not joint and therefore the petitioner is entitled to that seat. However, the petitioner avers, one Niranjana Rao who secured rank. No. 2856 belonging to B.C. (A) and who also given admission as a non-local in the Rangaraya Medical College in Andhra University Area, some how manoeuvred and got admission into the Kakatiya Medical Collegein the seat of Kum. Sujanamma that vacant. A representation was made by the petitioner claiming preferential treatment in respect of that seat, but no reply was received. Hence this writ petition.
(3.) In the counter filed by the respondent-authorities it is inter alia averred that the total number of seats reserved for B.C. (A; in the Osmania University area is '24', being 7% of 346 seats: Out of these '24', '7' being minimum of 30% were to be allotted to women candidates. However, in fact '9' candidates-mentioned hereunder are women candidates : <FRM>JUDGEMENT_836_ALT2_1988Html1.htm</FRM> Out of the above ('9', Kum. Sujanamma with rank No. 2133 did not join. In her place, Niranjan Rao with rank No, 2856, who was in the waiting list was given the seat in the Osmania University area. This Niranjan Rap was initially cleared as a non-local in the Andhra University area, but was kept in the waiting-list as a 'local' for the Osmania University. Nevertheless even in the second list there are '8' women candidates in the Osmania University area, which satisfies the rule of reservation for women. It is also averred that the last successful candidate in B.C. (A) Category in any University area is the candidate with rank No. 2862. Since the petitioner secured rank No. 3105, which is far below, she was not selected.
