JUDGEMENT

(1.) On the death of the permanent incumbent, the post of the village karnam of Boorada village fell vacant. On a notification being issued, five persons applied including the petitioner and the first respondent herein. The Revenue Divisional Officer selected the petitioner in preference to the first respondent. An appeal filed by the first respondent before the District Revenue Officer proved unsuccessful. The first respondent carried the matter in second appeal to the Board of Revenue. The Board of Revenue allowed the appeal and appointed the first respondent to the said post. The petitioner then approached the Government by way of revision, but in vain.

(2.) The petitioner does not belong to Boorada village. He is a member of the scheduled tribes. The petitioner has studied up to X class. He has passed both the village karnam and village munsif tests and has undergone the survey training. In fact he was trained as a village officer under a special scheme evolved by the Government to improve the prospects of the members of the scheduled tribes.

(3.) The first respondent is a resident of Boorada village and has passed his S S.L.C. examination. He too has passed both village karnam and village munaif's tests and has undergone survey training. He has been working temporarily in the said post pending a regular appointment.
