JUDGEMENT

(1.) The petitioner has, in the above writ petition, questioned the action of the respondents in not regularising his services inspite of the fact that the petitioner has been working as Music Teacher in the 3rd respondent Vidyalaya for five years since 1987 onwards until the date of filing the above writ petition. The petitioner apprehending threat of termination of his services filed the above writ petition and pursuant to an interim direction of this Court in the above writ petition, petitioner has been continued in service. As on date of hearing of the above writ petition, the petitioner has completed almost ten years of service in the post of Music Teacher.

The petitioner was called for interview by the 3rd respondent-Principal and after interview, was appointed as Music Teacher on 8-10-1987 vide Proceedings No.F/5-2/KV/ OF/87-88/346, dated 7-10-1987. Thereafter the petitioner's services were terminated by Proceedings dated 30-4-1988 w.e.f, 30-4-1988 (AM). Once again the petitioner was called for interview on 11-8-1988 and thereafter again appointed on 16-8-1988 and relieved from service on 30-4-1989 by similar order as in the first instance. In this manner, the petitioner has time and again been selected after interview appointed as Music Teacher and services were terminated vide orders dated 30-4-1988 i.e., last date of April each year. In 1991, the petitioner was again appointed as Music Teacher vide proceedings dated 20-7-1991 relieved from service on 16-1-1992 vide orders dated 16-1-1992 and again interviewed on 7-7-1992 and appointed vide orders dated 13-7-1992 and before his services could be terminated, the petitioner filed the above writ petition and was thereafter continued pursuant to the interim directions of this Court.

(3.) The petitioner has questioned the arbitrary appointment and termination and sought directions for regularisation of his services.
