JUDGEMENT

(1.) All the above Writ Petitions are being disposed of by this common judgment since they are between the same parties and also involve common questions. When the W.P.M.Ps came up for hearing, the learned Counsel for both parties submitted that the main Writ Petitions themselves can be disposed of accordingly the Writ Petitions are being finally disposed of by this common order after hearing the learned Counsel for both the parties.

(2.) Writ Petition No. 11937 of 1997 is filed by M/s. Sukhjeeka Industries represented by its Manager Damodar Lal, (who will be hereinafter referred to as the petitioner in this order) seeking an appropriate Writ Order or direction particularly one in the nature of Writ of Mandamus directing respondents 1 and 2 i.e., The Superintendent of Prohibition and Excise, Nizamabad and Superintendent of Police, Nizamabad respectively to perform their statutory duties preventing the third respondent i.e., M/s. Sri krishna Khandasari Sugar Mills, Sukjeeknagar, Nizamabad district from lifting and transporting 350 metric tonnes of molasses from the factory premises of third respondent and to pass such other order or orders as are deemed fit.

(3.) The other three Writ Petitions are filed by Sri Krishna Khandasari Sugar Mills, Sukhjeenagar, Nizamabad district (hereinafter referred to in this order as third respondent). In the said Writ Petitions the third respondent in substance seeks a declaration that it is entitled to store, sell and transport molasses from its factory without any restriction and that the official respondents have no right to interfere with the said right of the third respondent nor to interfere in the civil disputes between the third respondent on the one hand and the petitioner on the other.
