JUDGEMENT

(1.) This Second Appeal raises some important questions relating to the application of Section 14 (1) or (2) of Hindu Succession Act.

(2.) Except 1964-II A. L T. 371 : 1964 (II) An. W. R. 470 there is no other Bench decision on these important questions. The learned Counsel appearing for the respondent questions the correctness of this decision.

(3.) I am told that in a similar case a L P. A. (LPA. 98 of 1966) has already been admitted by the Bench and is pending disposal. I would therefore refer the can also to the Bench.
