RUNAKANA KANAKAIAH Vs. COMMISSIONER ELURU MUNICIPAL COUNCIL ELURU

JUDGEMENT

(1.) In this petition, the prayer is that all further proceedings for the election of the chairman to the Municipal Council of Eluru should be stayed pending the disposal or Writ Petition No. 508 of 1956 or until the election in Ward No. 25 of the Eluru Municipality takes place, etc. The circumstances leading up to this petition are these:

(2.) Elections to the Municipal Council, Eluru, were held in the month of June, for this year. The election of councillor for Ward No. 25 could not take place for reasons which need not be stated here.

(3.) The petitioner is one of the candidates for election from Ward No. 25. The Revenue Divisional Officer who is now acting as ex-officio chairman of the Municipal Council gave notice that a meeting for the election of the Chairman will be held on 14.07.1956. The petitioner wants that the Chairman's election should not take place pending the election for Ward No. 25 as he would not have an opportunity of taking part in the said proceedings and contesting for the Chairmanship.
