(1.) The sole accused in Sessions Case No. 105 of 2004 on the file of the Sessions Court. Adilabad, preferred this appeal. He was tried for the offence punishable under Section 302 of the Indian Penal Code (for short 'IPC'), convicted and sentenced to undergo imprisonment for life and to pay a fine of Rs. 1,000/-, in default to suffer simple imprisonment for six months.

(3.) When the charge was framed, the accused denied the same and claimed for trial. The prosecution, in order to prove the guilt of the accused, examined P. Ws. 1 to 10 and marked Exs.P-1 to 9 and M0. 1 pillow. On defence side, D.W.1 was examined, but no exhibits were marked. After completion of the trial, the learned Sessions Judge found the accused guilty of the offence and accordingly convicted him for the offence u/s. 302 IPC and sentenced him to undergo imprisonment for life and to pay a fine of Rs. 1,000/-, in default to suffer S.I. for six months. The accused, being aggrieved by the judgment of the learned Sessions Judge, date 9-6-2005, preferred the present appeal.
