JUDGEMENT

(1.) Today when the matter is taken up for hearing, learned counsel for the respondents has brought to the notice of this Court that they have filed a Memo dtd. 18/3/2008, before the Registry, stating that the sole-appellant has passed away on 3/4/2007, but no steps have been taken by the learned counsel for the appellants for bringing the Legal Representatives of the deceased sole-appellant on record. It is also noticed that this Court on 21/11/2017, has recorded that the "sole-appellant has passed away". Sri Abdul Md. Subhani, learned counsel on behalf Ms. Sindhu Kumari has represented that Ms. Sindhu Kumari, learned counsel for the appellant has also passed away during the pendency of the appeal.

As the sole-appellant has passed away on 3/4/2007 and further the learned counsel for the appellant has also passed away during the pendency of the appeal suit, no application is filed to bring the Legal Representatives of the sole-appellant on record, the present Appeal Suit is dismissed as abated. There shall be no order as to costs.
