(1.) This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:

Sri P.V.G.Umesh Chandra, learned counsel for the Petitioner would submit that, the Petitioner being the State President of a political party namely Bharata Chaitanya Yuvajana and a social activist, at the request of the famers, has been protesting against the land acquisition in Karedu Village, Ulavapadu Mandal, SPSR Nellore District with regard to Indosol India Private Limited Project. In that connection, the Petitioner along with his followers on the earlier occasions, conducted peaceful agitation, however, false cases were registered against the Petitioner and his followers. It is further submitted that, previously, in view of the visit of the Petitioner to Karedu Village on 03 08.2025, he made a representation dtd. 27/7/2025 to the Respondent - Authorities to grant permission and to deploy adequate police force for ensuring the said visit to be happened peacefully. As no response was received from the Authorities, the Petitioner filed W.P.No.20112 of 2025 before this Court, wherein, this Court vide Order dtd. 31/7/2025 directed the Respondent - Authorities to take an appropriate decision over the representation dtd. 27/7/2025 of the Petitioner according to governing rules and law. However, the said representation was not considered. Learned counsel would further submit that the Respondents are not allowing the seamless movement of the Petitioner by conduct a meeting at Karedu Village Centre, which is violative of Articles 19 and 21 of the Constitution of India.

Ms.A.Jayanthi, learned Government Pleader for Home, on written instructions, would submit that, as the Petitioner by gathering some innocent people, despite being issued a notice not to come to Karedu Village or participate in the said program, tried to block the National Highway No.16 against the land acquisition for the Indosol Solar System Project, and caused inconvenience to the general public and thereby interfered with the lawful duties of the Police and Revenue Officials. As such, a case in Crime No.88 of 2025 on the file of Ulavapadu Police Station has been registered against the Petitioner. Learned Government Pleader would further submit that, in view of the law and order problem at Karedu Village, Prohibitory orders under Sec. 163 of BNSS and Sec. 30(A) of Police Act have been proclaimed in Ulavapadu Police Station Limits from 1/8/2025 to 31/8/2025 by Respondent No.4 prohibiting to organize public meetings, processions, rallies and public gathering for the said purposes. It is submitted that in view of the situation in the subject are and due to prevailing law and order issues, the representation of the Petitioner to visit Karedu Village on 3/8/2025 was rejected. Learned Government Pleader would submit that there are 36 cases registered against the Petitioner in various Police Stations and the intention of the Petitioner to visit Karedu Village is nothing but to instigate the farmers who are against the land acquisition scheme. Hence, prayed for dismissal of the petition.
