JUDGEMENT

(1.) The accused-appellant was prosecuted for the offences punishable under sections 364. 302 and 201, I.P.C. before the Sessions Judge, Karimnagar, in Sessions Case No. 139 of 1991. On hearing the prosecution and defence of the accused the learned Sessions Judge same to the conclusion that the accused-appellant was guilty of the offences punishable under sections 364, 302 and 201, I.P.C. and therefore proceeded to convict him and sentenced him to undergo imprisonment for life for the offence under section 302, I.P.C.; for five years rigorous imprisonment for the offence under section 364, I.P.C. and two years rigorous imprisonment for the offence under section 201, I.P.C. The sentences of imprisonments awarded above were directed to run concurrently. Against the said convictions and sentences, the present Appeal is filed. It is alleged by the prosecution that the deceased was the mother-in-law of the accused. The accused had married Lakshmi, the elder daughter of the deceased, about two years prior to the incident. It was a love marriage. The accused was a rickshaw pullar.

It is further stated by the prosecution that the accused had been ill-treating Lakshmi i.e., his wife, in a drunken condition and he was not spending his earnings for the maintenance of the family and, therefore, the deceased, being the mother-in-law of the accused, used to chastise the accused for his conduct on many occasions and therefore the accused bore grudge against the deceased and had decided to murder her.

(3.) It is further stated by the prosecution that the accused was residing along with his wife at a distance of 100 feet from the house of the deceased. The deceased was residing at Karimnagar in a rented house with her two daughters and two sons and she had lost her husband two years prior to the incident and therefore she was working as Sweeper at Hyderabad in a private hospital. About two months prior to her death, she came back to Karimnagar and took up employment as a Sweeper in a private school by name Mano Vikas SchoolT in Mukkarrampura locality of Karimnagar Town.
