JUDGEMENT

(1.) Heard Sri A. Radha Krishna, learned counsel appearing for the appellants and Sri S.V.S.S. Siva Ram, learned counsel appearing for the respondents.

(2.) The respondents, who are the owners of the plaint schedule property, had entered into an agreement of sale, along with certain others, with the appellants herein, on 3/12/2018, for sale of the said property.

After execution of the agreement of sale and part payment of sale consideration, various disputes arose between the parties, due to which, the respondents are said to have informed the appellants, orally, that the agreement of sale, dtd. 3/12/2018, stood cancelled. Subsequently, a legal notice, dtd. 5/3/2022, was also issued on behalf of the respondents, intimating the appellants herein, about the cancellation of the agreement of sale and forfeiture of a sum of Rs.5,00,000.00 out of the advance paid by the appellants.
