IT can be seen from the record that the investigating officer failed himself to be examined in this case, and it can be seen that a number of contradictions are elicited from the evidence of the witnesses which are to be put to the investigating officer, when the investigating officer in a police case fails to appear before the Court to give evidence the case has to fail and there is no other way for the lower Court except to acquit the accused on that sole ground. On that ground and the other grounds, in the lower Court, the accused was given the benefit of doubt and he was acquitted. Therefore this is not a fit case where permission can be granted for filing the revision petition. Hence the revision petition is dismissed.
