MONOJ KUMAR Vs. STATE OF ANDHRA PRADESH

JUDGEMENT

(1.) This Criminal Petition, under Ss. 437 and 439 of Cr.P.C., has been filed by the petitioners/A-1 to A-5, seeking regular bail, in Crime No.79 of 2022 of Maredumilli Police Station, Alluri Sitharama Raju district.

(2.) A case has been registered against the petitioners herein and another for the offence punishable under Sec. 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NDPS Act').

(3.) Brief facts of the case are that, on 4/11/2022, at about 03.00 pm, at G.M. Valasa junction on the outskirts of Maredumilli village, A-1 to A-5, belonging to Odisha State, were found transporting 100 Kgs of Ganja supplied by A6 belonging to Odisha State in Ertiga Car bearing registration No.OD 30E 7080 and Honda City Car bearing registration No.AP 28 AS 5077 from Allurikota of Odisha State to Rajamahendravaram via Maredumilli village for commercial purpose. The contraband, along with vehicles and other material, was seized under cover of a mediators report. A1 to A5 were arrested on 4/11/2022 and sent to judicial remand.
