JUDGEMENT

(1.) The petitioners herein are working as Course Instructors in the Institute of Correspondence Courses (for short "the Institute") attached to Sri Venkateswara University, Tirupathi. When the correspondence course for B Ed, was started in the Institute in the year 1982, 6 persons were selected by the Director of the Institute as part-time assistants. The first petitioner is one among those selected. Subsequently, in the year 1985 an advertisement was made for appointment of Course Instructors by the first respondeat and petitioner Nos 2 and 3 were selected. Petitioner Nos. 4 and 5 who are kept in the waiting list at the time of the said selection were absorbed as Course Instructors on a consolidated salary of Rs. 1,200/- per month.

The grievance of the petitioners is that though the first petitioner has completed 8 years of continuous service from the year 1982 and petitioners 2 to 5 have completed about 5 years of service by the date of filing of the writ petition, their services have not been regularised on a regular scale of pay. All the petitioners did their post-graduation and acquired the qualification of M.Ed, petitioner Nos. 1, 2 and 4 did their Ph. D also.

The learned counsel for the petitioners argued that the action of the respondents in continuing the petitioners on a temporary basis on a consolidated pay of Rs. 1,200/- per month since 1982 for the first petitioner and since 1985 for petitioners 2 to 4 is arbitrary and illegal and, therefore, the respondents should be directed by a writ of Mandamus to regularise the service of the petitioners as Course Instructors in a regular scale of pay.
