JUDGEMENT

(1.) In this Writ Petition the petitioner questions Office Order No. NSF/EST/16363 dated 23.1.1992 transferring him and posting him as General Manager, Machinery Division at Nagarjunasagar.

The petitioner states that pursuant to an advertisement in English daily The Hindu dated 27.4.1989, which advertisement was also published in other dailies, given by the Nizam Sugar Factory Limited, Hyderabad for the post of General Manager, Marketing and certain other posts, he applied for the said post of General Manager, Marketing and that he was called for interview and that he was selected for the said post and he was appointed to the said post under letter NSF/EST/R303/601 dated 9.3.1990 and that he joined duty on 29.3.1990. The petitioner states that he successfully completed the period of probation and that he was confirmed in the said post with effect from 29.3.1991 under order- NSF/EST/2581 dated 14.5.1991. He was also sanctioned an annual increment in the said post on 7.10.1991. By the impugned order, the petitioner was transferred and posted as General Manager, Machinery Division, Nagarjunasagar.

(3.) The petitioner states that he obtained a Post Graduate Degree of M.B.A. in business administration having passed the qualifying examination in first class. He specialised in market management and also in finance. He states that in the year 1989 he got himself registered for a Ph. D. programme on a part-time basis in business administration. Though he obtained a post graduate degree in Engineering also earlier, the petitioner states that his executive career has been mostly in the field of Marketing Management and related areas in Electronics Corporation of India Limited at Hyderabad and in Andhra Pradesh Scooters Limited at Hyderabad, for nearly a decade. He mentioned his professional experience in his application for the present post of General Manager, Marketing and the said application discloses that during the period 1977-1982 he worked as Senior Technical Officer in Electronics Corporation of India Limited which involved the work of spare parts management support for all Indian Sales Service Network; during the period Feb., 1982 to April, 1986 he worked as Technical Manager in Electronics Corporation of India Limited which involved the work of Marketing Support Services and Planning; during the period April, 1986 to April, 1989 he worked as Deputy General Manager in Andhra Pradesh Scooters Limited heading Marketing and Corporate Planning Department; and during the period April, 1988 to April, 1989 he worked as Deputy General Manager in Andhra Pradesh Scooters Limited In-charge of Purchase and Planning Department and overseeing marketing. The petitioner states that he was invited by the Jawaharlal Nehru Technological University as Visiting Professor on deputation for teaching Marketing Management in view of his experience and qualification in the said field.
