JUDGEMENT

(1.) In this batch of writ petitions, the nine petitioners herein who are also petitioners in Writ Petition Nos. 6586, 6588, 6589, 6590, 6591, 6592, 6593, 6594, and 6596 of 1980 are challanging the proceedings in Re. No. 25665/EI-1/80 dated 1-7-1980 of the Secretary, Board of Intermediate Education-the 3rd respondent herein, as illegal and un-constitutional and therefore, not applicable to the colleges established and administered by the petitioners in each of the Writ Petitions, Admittedly the petitioners which are founders of the colleges established and administered by them, is a Christian Religious Minority. The impugned proceedings read as follows:

(2.) The matter has been carefully considered and the following modifications are given to the Rules of Admission issued in this office letter cited. Other provisions of the said Rules of Admission remain unaltered.

(3.) Such of those private colleges offering intermediate course (Junior and Degree) desirous of conducting an aptitude test for regulating admissions into first year Intermediate Course, are permitted to do so, subject to the condition that the weightage to be given to the aptitude test should not be more than 50% and the remaining weightage (i.e.) 50%) should be given to the marks obtained at the qualifying examination (i.e. SSC or equivalent). No minimum marki need be insisted upon for the aptitude test. The selection list should be prepared strictly on ths basis of common merit i.e on the marks obtained in the qualifying examination and the aptitude test. The marks given to the students in aptitude test and all other relevant documents connected with admissions should be preserved and produced at the time of scrutiny of admission by any competent body duly authorised by the Board of Intermediate Education and the Regional Inspection officers of the Board.
