JUDGEMENT

(1.) THIS Writ Petition has been filed for declaring the action of the 2nd respondent, Assistant Motor Vehicles Inspector, on special duty V & E, Madnoor Check Post, Nizamabad District, in seizing the vehicle bearing Registration No. AP 27 Y 4266, belonging to the writ petitioner, under Vehicle Check Report No. 0180670, dated 26.12.2010 as illegal.

(2.) THE 2nd respondent Assistant Motor Vehicles Inspector appears to have stopped the vehicle in question on 26.12.2010 at 10.30 p.m. and when the check revealed that the driver of the vehicle was plying the vehicle as express stage carriage by collecting individual fares and the vehicle was carrying commercial goods on the top of the body other than the passengers luggage, he seized the vehicle.
