JUDGEMENT

(1.) The same petitioner filed both these writ petitions. He joined the service of the erstwhile Rayalaseema Grameena Bank as Officer Scale-I in the year 1977. The bank has since been renamed as Andrha Pragathi Grameena Bank. The next promotion is to the post of Officer Scale -II.

(2.) The petitioner was served with a charge sheet in the year 1994. Another charge sheet was issued in the year 1997. Promotions to the post of officers Scale-II were taken up in the year 1998. However, in view of the pendency of the disciplinary proceedings against the petitioner, his case was considered, but the result of consideration was kept in a sealed cover. The disciplinary proceedings, against the petitioner ended without any blemish upon him. In view of this development, the respondents opened the sealed cover vide proceedings, 28-08-2010. Since the petitioner was found eligible to be promoted, he was extended the benefit of promotion as well as notional regularization and seniority with effect from 18-12-1998. His pay scale was also fixed in the post of Officer Scale-II. However, he was not extended the benefit of arrears of the salary for the post of Officer Scale-II with effect from 18-12-1998.

(3.) The respondents have taken up promotions to the post of officers Scale-III. On finding that his name was not shown in the seniority list in the cadre of Officer Scale-II, the petitioner filed WP No.33685 of 2010 with a prayer to declare the action of the respondents in not including his name in the seniority list, in the cadre of Officer Scale He has also sought for a consequential direction to consider his case for promotion to the next higher post on par with his juniors.
