(1.) The petitioner filed this writ petition praying for the issuance of a writ of ceitiorari and quash the order of the Labour court. Hyderabad dt. 8-4-80 passed in I.D. No. 20/77 on its file.
(2.) The petitioner is having a factory at Balanagar, Hyderabad and is engaged in the manufacture of safety razor blades of various kind's. The petitioner contends that some of the employees instigated an illegal strike and also refused to do their duties. Hence the 1st respondent (G. Pandu) herein and some others were issued charge sheets and an enquiry was held against them, Similarly the 2nd respondent (Kumar' K Vijayanthi) and some others were also charge sheeted and a separate enquiry was held).
(3.) Originally one Kamalakar Rao an employee of the Asbestos Company was appointed to conduct enquiry as against Pandu and others. But as Mr. Kamalakar Rao expressed his inability to conduct the enquiry, Sri S.Gopal was appointed as an enquiry officer in his place. At the request of the workers a joint enquiry was conducted. The matter was adjourned from time to time till 20-7-76. On that day in the enquiry against the 1st respondent and others, seven witnesses were examined by the Management. Statements of the witnesses were furnished to the representative of the workers and then it was adjourned to 23-7-76. On that day the Management filed a memo for examining two more witnesses and the copy of the same was furnished to the reperesentative of the workers. The Enquiry Officer allowed the memo permitting the Management to examine additional witnesses. Accordingly the Management examined two witnesses. Those witnesses were duly cross examined by the workers representative. After the evidence on the Management side was closed the statements of the charge-sheeted woikers were recorded. The workers requested time for production of their defence witnesses. Hence the matter was adjourned to 26-7-1976. Again at the request of the workers it was adjourned to 29-7-76. 01 29-7-76 the workers examined five witnesses and the defence was closed.
