JUDGEMENT

(1.) The Government of Andhra Pradesh had issued notification bearing No.01/Home/2020, Dated Nil-01-2020, inviting applications for recruitment to the post of Grama Mahila Samrakshana Karyadarsi/Ward Mahila Samrakshana Karyadarsi. It was stipulated that any person possessing any degree from any University in India established or incorporated by or under a Central Act, State Act or a provincial Act or an institution recognized by the University Grants Commission or by a recognized State Board of Technical Education and training would be eligible for the post of Grama Mahila Samrakshana Karyadars/Ward Mahila Samrakshana Karyadarsi.

(2.) The petitioners, who are all graduates, having completed their graduation in B.Sc. Honors as main stream from Human Development and Family Studies, Home Science extension and communication Management and Food and Nutrition, have filed the present writ petition being aggrieved by the educational qualification stipulated in the above notification. The contention of the petitioners is that the posts notified for recruitment requires people, who have specialized training which is available in the degrees obtained by them. In these circumstances, they seek a declaration and direction that the post should be reserved for persons holding B.Sc. Honors Home Science Degree alone.

(3.) Smt.S.Parinteeta, learned counsel for the petitioners relies upon the Judgment of the High Court of Jammu and Kashmir in the case of H.S.Sahni v. State of Jammu and Kashmir 2001(3) SCT 723 (J&K) for the proposition that the qualifications prescribed for appointment should rational in excess for the requirement of service and appointment should be made with such specialised persons.
