JUDGEMENT

(1.) This Writ Petition has been filed to declare the action of the respondent authorities in proposing to shift the Grama Sachivalayam from the existing place at C.Kandulavaripalli as mentioned in the proceedings in R.C.No.AEE/GS Bldg with addl. Space for Health and Ag.Dept/MGNREGS with convergence grant/2020, dated 13.06.2020 to K.K. Vaddipalli which is situated about 4.5 Kms away from the other hamlets, as highly arbitrary, illegal, null and void and against the principles of natural justice, discriminatory and contrary to the proceedings issued by the 4th respondent and consequently to direct the respondent authorities to construct Grama Sachivalaya at the place as mentioned in said proceedings.

(2.) Heard Sri Balaji Medamalli, learned counsel for the petitioner, learned Government Pleader for Panchayat Raj and Rural Development appearing for respondent Nos.1 to 4 and Sri V. Vinod K Reddy, learned Standing Counsel appearing for respondent Nos.5 to 7. With the consent of the both counsel, this writ petition is disposed of at the stage of admission.

It is the case of the petitioner that after the establishment of village volunteers and Grama Sachivalayam system, the respondent Nos.3 and 4 have proposed to construct a new Village Secretariat to provide space for other wings i.e., Medical and Agriculture Departments at the place of existing panchayat Office in C.Kandulavaripalli Village and after preparing the plan and also allocation for funds, the 3rd respondent has accorded administrative sanction to the said proposal vide proceedings in R.C.No.AEE/GS Bldg with addl.Space for Health and Ag.Dept/MGNREGS with covergence grant/2020, dated 13.06.2020 at S.No.40 and the respondents have identified an extent of Ac.0-08 cents out of Ac.4-38 cents of Government land in Survey No.838-A of C.Kandulavaripalli for construction of Grama Panchayat and the other buildings.
