THIS appeal has been directed by opposite party Nos. 1 and 2 against order dated 9.5.2005 passed by Consumer Disputes Redressal Forum -I (hereinafter to be referred as District Consumer Forum), whereby the complaint filed by Ravinder Singh, etc. was accepted and the appellants were directed to provide basic amenities like parking space and approach road to the site allotted to complainants within a period of 6 months from the date of receipt of certified copy of the order and further ordered that penal interest would not be charged on the instalments that had become due to be paid. Compensation of Rs. 10,000 was also awarded to them besides costs of litigation of Rs. 1100.

BRIEFLY stated the facts are that the respondents (complainants) had purchased SCO site No. 320, Sector 40 -D, Chandigarh, for Rs. 55,15,000 in an auction held on 7.1.2003 and deposited Rs. 13,78,750 as 25% of the cost of site. The allotment letter dated 24.4.2003 was issued to the respondents. The balance amount was to be paid in three equated instalments. Respondents took possession of the site in question and made construction upon it and occupation certificate was issued on 24.11.2003, whose copy is Annexure C -2. However, the appellants did not provide the basic amenities like approach road/parking space and as such respondents could not use the SCO properly, thus, they filed the complaint alleging deficiency in service on the part of appellants and demanded Rs. 5 lacs as compensation and further prayed that the appellants be restrained from charging interest on the balance amount till the basic amenities were provided.
(3.) THE appellants contested the complaint and admitted the factum of purchase of site in question bearing No. 320, Sector 40 -D, Chandigarh by the respondents. They further stated that storm water disposal lines and sewerage were provided much earlier. Estimate regarding parking lights was prepared and was under consideration with the administration. However, they admitted that parking/approach road did not exist at the site.
