JUDGEMENT

(1.) THIS appeal is directed against order dated 18.6.2010 of the learned District Forum, North Goa at Porvorim by which the complaint dated 4.8.2008 has been dismissed.

(2.) THE parties hereto are hereinafter referred to in the name as they appear in the cause title of the said complaint.

(3.) THERE is no dispute that the complainant purchased a Sony Ericsson mobile W580i Boulevard .Black at the cost of Rs.12,000 from Ashish Enterprises (Opposite Party No.1). The said hand set had a conditional warranty for a period of one year and two of the conditions referred to by the parties at the time of hearing of this appeal read as follows:
