JUDGEMENT

(1.) THIS is an appeal against the order dated 18.12.2004 passed by the District Forum, Udham Singh Nagar whereby the complaint of the complainant was allowed for a compensation of Rs. 5,000/ - and cost of litigation of Rs. 1,000/ -.

(2.) THE brief facts of the case are that the complainant applied for the post of Inspector in Uttaranchal Krishi Utpadan Mandi Samiti. For post the written examination was to be held on 28.12.2003. On 3.12.2003 the Mandi Samiti sent the admission card to the complainant through registered post from Gurukul Kangri, Haridwar, which the complainant received on 29.12.2003. Since the examination was held on 28.12.2003, therefore, the complainant could not appear in that examination. The complainant alleged that now he is 35 years old and, therefore, he cannot apply for any other examination. It is said to be deficiency in service of the postal department and, therefore, he filed the complaint.

(3.) THE opposite party filed written statement and denied the allegations and alleged that the speed post was sent on 23.12.2003, which was received in the Kashipur Post Office on 29.12.2003 and it was delivered to the complainant the same day. There is no deficiency in their service.
