JUDGEMENT

(1.) THIS appeal is directed against the order dated 4.3.2006 passed by the District Forum, Tehri Garhwal in consumer complaint No. 56 of 2004. Vide the impugned order, the District Forum has allowed the consumer complaint and directed the opposite parties to pay to the complainant sum of Rs. 5,360 for the deposits made by him and Rs. 1,000 towards litigation expenses, within a month from the date of the order.

(2.) THE facts of the case, in brief, are that the complainant Sh.Betal Singh Negi had an account No. 1221/251 with M/s. Agrim Finance and Commercial Pvt. Ltd., which was opened on 21.4.2003. The account was of the nature of a daily saving scheme and complainant had deposited his savings @ Rs. 20 per day starting from 21.4.2003 till 17.1.2004 amounting to Rs.5,360. The complainant has alleged that the company closed its office in February, 2004 without making any payment to him. This led the complainant to file a consumer complaint before the District Forum, Tehri Garhwal. The District Forum vide order impugned dated 4.3.2006 allowed the consumer complaint in the above manner. Aggrieved by the said order, the opposite party Nos. 1 and 2 have filed this appeal, impleading the complainant as respondent No. 1 and opposite party Nos. 3 and 4 as respondent Nos. 2 and 3.

(3.) WE have heard the learned Counsel for the appellants and respondent No. 1. None appeared on behalf of respondent Nos. 2 and 3. We have also perused the material placed on record.
